Article 1: General provisions
The e-commerce website of Wes'thetique, a one-man business with registered office at Vlierhof 8, 3550 Heusden-Zolder, VAT BE0555 939 563, (hereinafter 'Wes'thetique'), offers its customers the opportunity to purchase the products from its webshop online to purchase.
These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). Wes'thetique expressly reserves the right to change prices and correct any errors. Wes'thetique cannot be held liable for any (writing) errors in its prices or conditions.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. The offer is valid while stocks last and can at any time be adjusted or withdrawn by Wes'thetique. Wes’thetique cannot be held liable for the unavailability of a product:
- If an offer has a limited duration or subject to conditions, this will be explicitly stated in the offer.
- If the product is not in stock at the supplier. In this case, the Customer will be informed about this by e-mail and a possible solution can be sought (eg later delivery date, refund or choice for another product with the same value as the originally ordered product)
Article 4: Online purchases
Description of the Order procedure:
The Customer chooses the goods he wants to order and can add them by clicking on the “Add to cart” button. After the Customer has made his choice in the webshop, he can continue to process his order via the button “To checkout”. After this an overview is shown of the goods in the shopping cart. At the moment, the Customer still has the option to make adjustments (add or remove goods) to his goods in the shopping cart. If necessary, the Customer can give a comment with regard to the goods. The Customer then goes to the page where the Account and delivery address data must be entered via the “Next step” button. When the Customer has filled in the required fields, he can go to the next page via the "Next step" button. On this page, the Customer must choose his payment method. When the Customer has selected the payment method, he can go to the confirmation page again via the "Next step" button. On this page, the Customer has the option to change the billing and delivery address and he can still change the payment method. In addition, this page also shows an overview of the order (product overview, price / unit, quantity, subtotal, shipping costs and total amount). To proceed with a definitive order, the Customer is deemed to accept the general terms and conditions and the cancellation notice and to press the button “Order with payment obligation”. Wes'thetique is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.
Article 5: Delivery, execution of the agreement and returns
The delivery time is expressed in working days.
Items ordered through this webshop are delivered in Belgium, the Netherlands and Luxembourg
If the Customer has ordered items with different delivery times, the Customer must take into account the longest delivery time.
The delivery time is only a guideline. The delivery period can be extended in case of force majeure (eg strike at Bpost, the goods not in stock at the supplier, ...)
Delivery is made by Bpost to the address specified by the Customer.
The costs for delivery are € 6.00 incl. VAT. However, if the Customer places an order with a value of more than € 75.00 incl. VAT, the costs for the delivery of the goods will be borne by Wes'thetique.
Any visible damage and / or qualitative shortcoming of an article or other shortcoming in the delivery must be reported by the Customer to Wes'thetique without delay.
The risk of loss or damage is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by the Wes'thetique.
Article 6: Retention of title
The delivered items remain the exclusive property of Wes'thetique until the moment of full payment by the Customer and are only shipped from the moment that the amount due has been paid in full.
The Customer undertakes, if necessary, to inform third parties of the retention of title of Wes'thetique, for example to anyone who would seize the articles not yet fully paid for.
Article 7: Right of withdrawal
The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from Wes'thetique.
The Customer has the right to withdraw from the agreement within 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

If the Customer cancels the agreement, Wes'thetique will refund all payments received from the Customer up to that time for the order to which the withdrawal applies, including the standard delivery costs, within a maximum of 14 calendar days after Wes'thetique on the has been informed of the Customer's decision to withdraw from the contract. In the case of sales agreements, Wes'thetique can wait with the reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever is the earlier.
Any additional costs resulting from the choice of the Customer for a different method of delivery than the cheapest standard delivery offered by Wes'thetique will not be refunded.
Wes’thetique pays the Customer back with the same payment method as with which the Customer carried out the original transaction, unless the Customer has explicitly agreed otherwise; in any case, the Client will not be charged for such reimbursement.
Article 8: Warranty
Under the law of 21 September 2004 on consumer protection in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

When a defect is found, the Customer must inform Wes'thetique as soon as possible, but no later than 14 calendar days after receipt. This can be done by post or e-mail. Afterwards, all rights to repair or replacement.
The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Article 10: Penalties for non-payment

Neither Wes’thetique nor Blackpoint therefore gives any guarantee whatsoever with regard to the possible similarity between the Blackpoint perfumes and the mentioned Brand perfumes.
It is up to the customer and the customer alone to assess whether he can recognize the notes of the brand perfumes in the Blackpoint perfumes.
Article 18: Cancellations
If you do not show up, I will charge the full amount before a new appointment can be made.
I will charge half of the booked amount within 24 hours.
Canceling within 48 hours is possible without additional costs.
Article 19: Training
Training courses within Wes'thetique must be paid in advance.
Payments must be made within 7 days after you have confirmed the training with Wes'thetique.
Canceling a training must take place at least 2 weeks before the planned date to move your paid amount to a new date.
Paid training cannot be refunded under any circumstances.
If the training is canceled by Wes'thetique, a full refund is possible.
